{"id":3079,"date":"2014-11-09T10:37:38","date_gmt":"2014-11-09T09:37:38","guid":{"rendered":"http:\/\/pierrejohnson.eu\/wp\/?p=3079"},"modified":"2018-02-08T16:06:39","modified_gmt":"2018-02-08T15:06:39","slug":"nagoya-pyeongchang-2014-2","status":"publish","type":"post","link":"https:\/\/www.pierrejohnson.eu\/en\/nagoya-pyeongchang-2014-2\/","title":{"rendered":"Biodiversity and Trade: The Nagoya Protocol entered in force on Oct 12, 2014"},"content":{"rendered":"<table>\n<tbody>\n<tr>\n<td><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-896\" src=\"http:\/\/pierrejohnson.eu\/wp\/wp-content\/uploads\/2011\/12\/cbd_nagoya-300x201.jpg\" alt=\"cbd_nagoya\" width=\"197\" height=\"132\" \/><\/td>\n<td><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-3057 size-medium\" src=\"http:\/\/pierrejohnson.eu\/wp\/wp-content\/uploads\/2014\/08\/mujica-conferencia-prensa-300x217.jpg\" alt=\"mujica-conferencia-prensa\" width=\"300\" height=\"217\" \/><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Ratification by\u00a0Uruguay (above) allowed the\u00a0<a href=\"https:\/\/www.cbd.int\/abs\/\" target=\"_blank\" rel=\"noopener\"><strong>Nagoya\u00a0Protocol<\/strong><\/a> on access to genetic resources and equitable sharing of its benefits to enter in force on October 12th, 2014, that is\u00a090 days after the reception of this\u00a050th ratification.\u00a0This date is the day before the first <a href=\"http:\/\/www.cbd.int\/cop\/\" target=\"_blank\" rel=\"noopener\">Conference of Parties<\/a> to the Convention on Biological Diversity which was held\u00a0in <strong>Pyeongchang<\/strong>, South Korea, from October 13 to 17.<\/p>\n<p><!--more--><\/p>\n<p>With its complete name, the\u00a0<i><strong>Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization<\/strong>\u00a0<\/i>aims, as it names says, at\u00a0a fair and equitable sharing of the benefits arising from the utilization of genetic resources, through adequate and timely compensation to holders of resources and by appropriate transfer of relevant technologies. This mechanism seeks to contribute to the conservation of biological diversity and the sustainable use of its components. It was adopted by the Conference of Parties to the Convention on Biological Diversity\u00a0at its tenth meeting, on 29 October 2010 in Nagoya, Japan. Each country specifies the procedures for access to genetic resources, under the principles of the Protocol. In March 2014, the European Parliament finally approved the regulation to ratify and implement the Nagoya Protocol in the European Union.<\/p>\n<p>The definition of genetic resources\u00a0and the degree of constraint for the different types of players (companies, research laboratories, institutions, etc.) were at stake in recent negotiations.<\/p>\n<p>Any research on elements of local biodiversity, such as plant extracts, oils or molecules for the development of new drugs or cosmetic ingredients, or any use or reference to traditional knowledge\u00a0enters the scope of the Nagoya Protocol, making compulsory a request for voluntary access and benefit sharing (<strong>ABS<\/strong>), under terms defined by mutual agreement.<\/p>\n<p>From this multilateral framework, signatory countries must implement the laws and regulations defining the scope and procedures of the APA in their territories. The European settlement was approved in March 2014, after more than a year of discussion. Centered on the concept of &#8220;due diligence&#8221; of users of genetic resources in the European Union, it relies on\u00a0companies and institutions responsible for ensuring the compliance of the use of genetic resources and traditional knowledge with the rules ABS\u00a0defined by the supplier country.<\/p>\n<p>With the implementation\u00a0of the Nagoya Protocol, companies and research and development laboratories deriving their ingredients from\u00a0components of biodiversity (plants, organic compounds &#8230;), or based upon traditional knowledge, will have to follow changing national laws and regulations on ABS and adopt best practices. These will be subject to verification by the checkpoints based in the Member States of the European Union, among others. This requirement is of concern\u00a0to\u00a0many company departments or institutions.
